§ 96.04 LOCATION, SPACING OF NEW TREES ON PUBLIC PROPERTY.
   (A)   Spacing. No trees may be planted on public property closer together than the following, except in special plantings described or approved by the Tree Advisory Board:
      (1)   Small trees: 30 feet;
      (2)   Medium trees: 40 feet; and
      (3)   Large trees: 50 feet.
   (B)   Distance from curb or sidewalk. The distance trees may be planted from curbs or curblines and sidewalks will be in accordance with the three species size classes. No trees may be planted closer to any curb or sidewalk than the following:
      (1)   Small trees: two feet;
      (2)   Medium trees: three feet; and
      (3)   Large trees: four feet.
   (C)   Distance from street intersections. No street trees or park trees shall be planted within 35 feet of any street intersection, measured from the point of nearest intersecting curbs or curblines, or within 15 feet of any driveway or alley. If no such curb or curbline exists, no tree shall be planted within ten feet from the point of intersection of the property lines.
   (D)   Distance from utility wires, utility lines and fireplugs. No street tree or park tree other than those species indicated as small trees may be planted under or within ten lateral feet of any overhead utility wire, or over or within five lateral feet of any underground water line, sewer line, transmission line or other utility line, wire or main. No street tree shall be planted within ten feet of any fireplug.
   (E)   Arrangement of trees in sidewalk spaces. All trees permitted to be planted in sidewalk spaces shall conform in line with the majority of trees already planted in the blocks. If no trees are planted therein, the trees as are permitted to be planted under this chapter shall be an equal distance from the sidewalk and from the curb. Not more than two trees shall be planted in one lot in the sidewalk space.
