§ 91.08 PERMITTED FIRES.
   (A)   It shall be lawful to build or set fires within the city, provided that the fires may be set in an incinerator built in compliance with National Fire Code, Volume 7, Chapter 82, and further provided that the incinerator has been inspected and approved for use by the Fire Chief or his or her designated representative.
   (B)   Burning of straw, leaves, or brush in the open air will be permitted only after a permit has been obtained from the Fire Chief or representative. Persons seeking a permit may apply at the Public Safety Center from 8:00 a.m. to 5:00 p.m. Monday through Friday. Open burning should be attended at all times by the person setting the fire. No fire shall be allowed any closer than ten feet from any building and the person setting and overseeing the fire shall at all times keep the fire under control and have a means of extinguishment close at hand.
