§ 72.37 TRUCKS AND OTHER SPECIFIED VEHICLES.
   (A)   It shall be unlawful for any person to park, or leave standing, on any street, alley, public right-of-way, or private premises in any area of the city zoned Residential, any vehicle containing garbage, or dead or rotting animal matter. Any vehicle parked in violation of this section is declared to be a nuisance.

   (B)   It shall be unlawful for any person to park or leave standing on any street, alley, public right-of-way, or private premises in any area of the city zoned Residential, any petroleum or petroleum distillate transport vehicle. Nor shall any person park or leave standing on any street, alley, public right-of-way, or private premises in any area of the city zoned Residential, any anhydrous ammonia transport vehicle or any vehicle used to store or transport anhydrous ammonia or other farm or industrial chemicals. Any vehicle parked in violation of this section is declared to be a nuisance.

   (C)   Except under authority of a valid permit issued as set out herein:
      (1)   It shall be unlawful for any truck, truck-tractor, or trailer, except for trucks with a rated carrying capacity of less than one and one-half tons (3,000 pounds), to be parking or stored, on any street, alley, or public right-of-way where parking is permitted in any part of the city which is zoned as Residential-Low Density, Residential-Medium Density, Residential-Medium Density Mobile Home, or Residential-High Density of the city; and moving vans may be exempted up to 24 hours for loading and unloading.
   (D)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      TRAILER. Any vehicle, with or without motive power, designed for carrying persons or property and for being drawn by a motor vehicle.
      TRUCK. Any motor vehicle not designed, used or maintained primarily for the transportation of persons as a passenger vehicle. The definition of TRUCK shall include all common carriers, all motor vehicles designed, used, or maintained primarily for the transportation of property or equipment, and shall include all vehicles which constitute commercial vehicles under Neb. RS 60-301 to 60-335 inclusive.
      TRUCK-TRACTOR. Any motor vehicle designed and primarily used for drawing other vehicles and not so constructed as to carry a load other than a part of the weight of the load so drawn.
   (E)   The fact that a truck, truck-tractor, or trailer, which is legally parked, is registered in the name of a person shall be considered prima facie proof that the person was in control of the truck, truck-tractor, or trailer at the time of the parking.
   (F)   The City Manager shall be empowered to issue permits for the parking of trucks, truck-tractors, or trailers in the residential areas of the city as required by this section.
      (1)   The permits and applications for permits shall appear on forms approved by the City Manager.
      (2)   The permits shall be for a period not to exceed 72 hours and the period shall be displayed prominently on the permit.
      (3)   Any alteration of a permit issued hereunder shall constitute a violation of this section.
      (4)   The permit shall be issued upon a showing by the applicant of a reasonable necessity for purposes of loading or unloading only to exceed the limits set by this section. However, no permit shall be issued for a vehicle when the parking of the vehicle would constitute a nuisance under city ordinances or state law, nor for any other purpose than loading or unloading.
      (5)   Any misrepresentation or false statements in an application for a permit shall constitute a violation of this section.
      (6)   The City Council is empowered to promulgate such further rules and regulations as are necessary for the implementation and operation of the permit system hereunder by resolution.
