(A) On any premises for which water charges have not been paid within 25 days after they have become due, the Utilities Director shall begin the discontinuance of service process, complying with the requirements of § 50.02. When the water is turned off by reason of failure to pay, the water shall not be turned on until the customer has paid all delinquent water charges, has paid a security deposit as prescribed in § 52.03, and in addition thereto has paid a reconnection fee set by ordinance of the City Council. The fee shall be on file at the office of the City Clerk and is set out in Chapter 38, Fee Schedule.

(B) In addition to all other remedies, if a customer shall for any reason remain indebted to the municipality for water services furnished, such amount due, together with any rents and charges in arrears, shall be considered a delinquent water rent which is hereby declared to be a lien upon the real estate for which the same was used. The City Clerk shall report regularly to the governing body a list of all unpaid accounts due for water, together with a description of the premise upon which the same was used. Any delinquent water charges which remain unpaid for a period of three months may be assessed by resolution against the real estate where supplied as a special tax assessment.

(C) The city shall notify in writing nonoccupying owners of premises or their agents whenever their tenants or lessees are 60 days delinquent in the payment of water rent. Thereafter, if the owner of the real estate or his or her agent within the city shall notify the Council in writing to discontinue water service to the real estate or the occupants thereof, it shall be the duty of the officer in charge of the Water Department promptly to discontinue the service; and rentals for any water furnished to the occupants of the real estate in violation of the notice shall not be a lien thereon.
