Any law enforcement officer finding a person 17 years of age and under violation of § 176.01 shall take such person to his or her home, discuss the provisions of this chapter with the parent, guardian, or custodian, and issue a warning citation. However, if such person cannot be found or lives outside the village, the police officer may detain any person who is found in violation of this chapter in a convenient place, and notify the parent, guardian or custodian of his action. On a second violation by the person, process shall be issued against the minor, and, or against the parent, guardian or custodian.
