§ 174.999 PENALTY.
   (A)   Section 174.001 is hereby declared to be a nuisance law and whoever violates any of the provisions of that section shall be ordered to abate said nuisance within ten days from a finding that said nuisance exists, and a fine of $75 per day shall be imposed thereafter if such violation should continue. The Court may impose said fine on its own motion after said ten day period until evidence of abatement is received.
   (B)   Violations of §§ 174.015 through 174.023.
      (1)   Whoever violates any provision of §§ 174.015 through 174.023 is guilty of a minor misdemeanor and shall be fined not less than $25.
      (2)   If within one year of the offense, the offender has been convicted of, or has pleaded guilty to, one or more violations of a section under that subchapter, the offender is guilty of a misdemeanor of the fourth degree.
      (3)   In all cases wherein a person has been convicted of or pleaded guilty to a violation of any provision of §§ 174.015 through 174.023, the court shall, in addition to any fine or sentence imposed upon the offender, order the nuisance abated within seven days.
      (4)   Nothing in this penalty section shall prevent the village from pursuing other actions or charges under the Ohio Revised Code.
   (C)   Whoever violates § 174.037 is guilty of a minor misdemeanor for a first offense, $50 fine, and is guilty of a misdemeanor of the fourth degree for a second subsequent offense. Each day's violation shall constitute a separate offense.
   (D)   Whoever violates any of the provisions of §§ 174.050 through 174.052 shall be guilty of a minor misdemeanor.
   (E)   Fee schedule for assessments to property owner tax duplicate for nuisance violations:
