It shall be unlawful to bargain for the sale or lease of any gambling device described in this subchapter, to collect money, to take compensation for such sale or lease, or to take or accept money from any person or from any such machine as a share or royalty, compensation for such lease or sale. Proof of such machine or device when seized has not been used or is out of repair shall not constitute a defense to a prosecution under this subchapter.
