(A) The annual license fee for a retail tobacco dealer’s license, tobacco shop and smoking lounge shall be as set forth in § 110.13 (cigarettes/tobacco dealer, tobacco shop and smoking lounge) of this Code.
(B) The licensing period relative to the annual license fee shall commence on the first day of each year and shall expire on December 31 following the date of issuance.
(C) The number of licenses for certain types of businesses shall be capped as follows:
(1) No more than 2 licenses to engage in the business of a tobacco shop shall be active at any 1 time; and
(2) No more than 6 licenses to engage in the business of a smoking lounge shall be active at any 1 time.
(D) After September 10, 2024, no new retail tobacco dealer’s license shall be issued except to retail goods establishments, as defined in the Maywood Zoning Ordinance, occupying a minimum of 10,000 square feet of gross floor area (GFA) (GFA means the total building footprint including retail sales area, interior bathrooms, storage areas and cashier areas). Retail tobacco dealer’s licenses held by retail goods establishments in effect on September 10, 2024 that do not meet the square footage requirements set forth in this section may only be renewed by the current licensee provided that the licensee and the licensed premises comply with all other applicable statutes, ordinances, rules and regulations relative to operation of the licensed establishment, except for the square footage requirements set forth in this section.
