§ 114.07 COIN AND NON-COIN OPERATED AMUSEMENT DEVICES.
   (A)   (1)   The term COIN AND NON-COIN OPERATED AMUSEMENT DEVICE means any fortune telling machine, palm reading machine, pinball machine, or any other machine or device for a game of skill or science which does or does not return to the player of the device money or property or the right to receive money or property and which is governed or controlled by the deposit of a coin or token in a coin slot affixed to the machine, game or device or which is activated, governed, or controlled by a remote control switch, key, pushbutton or other mechanism or means, or activated in any other fashion.
      (2)   The term coin and non- coin operated amusement device does not include pool tables, billiard tables or other similar types of game tables which are controlled by a coin operated locking device, or any device lawfully licensed and operated as authorized by Chapter 125 of this Code and pursuant to the Video Gaming Act, 230 ILCS 40/1 et seq.
   (B)   Possession, operation or maintenance of coin and non-coin operated amusement devices in the Village is prohibited except as set forth below.
   (C)   Coin and non-coin operated amusement devices may be located, maintained and operated within the Village upon premises for which an organization has obtained and holds: (a) a valid Class D liquor license properly issued pursuant to Chapter 116 of this Code; or (b) a valid Class N liquor license, a coin and non- coin operated amusement device license as herein provided. A separate coin and non-coin operated amusement device license shall be required for each individual coin and non-coin operated amusement device.
   (D)   Application for a coin and non-coin operated amusement device license shall be made in conformity with Chapter 110 of this Code except as otherwise may be provided in this section. The application shall set forth:
      (1)   The location of the premises where the coin or non-coin amusement device is to be located, maintained, or operated; and
      (2)   The charge to be made to the player for operating the device.
   (E)   No more than 4 coin or non-coin operated amusement devices may be located, maintained or operated in any one establishment.
   (F)   The fee for each license to locate, maintain or operate a coin or non-coin operated amusement device shall be as set forth in § 110.13. The Village Clerk shall issue a decal or sticker to each organization that obtains a license to locate, maintain or operate such an amusement device. This decal or sticker must be affixed by the applicant to the licensed amusement device in a conspicuous place and must be kept on the device during all times the device is in use.
   (G)   No license issued under this section shall be transferable.
   (H)   No license issued hereunder shall permit the operation of a coin or non-coin operated amusement device in a manner which will disturb the peace of persons otherwise properly within or without the premises where the amusement device is located. No license issued hereunder shall permit the operation of such an amusement device where the operation amounts to a nuisance in fact. The operation of such a device which provides a return of money or property is prohibited, and no license issued hereunder shall be deemed to permit the operation of any such device in such a manner.
   (I)   Nothing in this section shall be interpreted as prohibiting the possession, maintenance and operation of a coin or non-coin operated amusement device in private residence for the use and enjoyment of the lawful occupants thereof and their guests. Nothing herein shall prohibit the manufacture or sale and possession incidental thereto of such coin or non-coin operated amusement devices.
   (J)   Any person having obtained a license to locate, maintain or operate a coin operated amusement device issued prior to July 31, 1979, may continue to enjoy the privileges of said license until such time as said license expires. No new license for the location, operation and maintenance of a coin operated amusement device in the Village shall be issued except as provided in this section.
