§ 111.31 TOBACCO DEALERS.
   (A)   Retail. Retailers of tobacco products are subject to the licensing requirements and procedure set forth in Chapter 116 of this Code.

   (B)   Wholesale.
      (1)   Definition. The term WHOLESALE TOBACCO DEALER means any person making, manufacturing or jobbing cigars, or selling, offering for sale, exposing for sale or keeping with the intention of selling or exchanging, at wholesale, any tobacco, snuff, cigars, cigarettes or cigarette papers, including leaf tobacco, or any preparations containing tobacco.
      (2)   License. No person shall engage in the business of a wholesale tobacco dealer without a license therefor. The fee shall be as set forth in § 110.13.
      (3)   Application; investigation.
         (a)   An application for a wholesale tobacco dealer's license shall give the location and a description of the premises.
         (b)   The Building Director shall investigate or cause an investigation to be made of the premises named and described in the application for the purpose of determining the fitness and suitability of such premises for such business from a sanitary standpoint and for determining whether or not the premises comply with all the provisions of this Code and laws of the state regulating health, safety and sanitation, so as properly to safeguard the lives and health of the employees engaged therein.
         (c)   The Chief of Police shall cause an investigation to be made to determine the character and fitness of the applicant and to determine whether the premises named in the application comply with the police regulations of this Code.
      (4)   Sanitary requirements; inspections.
         (a)   All places or establishments where tobacco, snuff, cigars or cigarettes are sold or kept with the intention of selling at wholesale shall at all times be kept in a clean and sanitary condition. No tobacco, snuff, cigars or cigarettes shall be kept or stored in any barn or stable or any place where the same are liable or subject to contamination. All appliances, cutters, receptacles or cases used by any wholesale tobacco dealer in the handling of products authorized to be sold under the terms of such license shall be kept in a clean and sanitary condition.
         (b)   It shall be the duty of the Building Director and they are authorized and empowered from time to time to inspect and examine all places where tobacco, snuff, cigars or cigarettes are licensed to be sold within the Village, with a view of ascertaining whether the laws of the state and the provisions of this Code in relation to the adulteration of and handling and sale of such commodities are being complied with at such places, and it shall be their duty to cause all such laws and provisions of this Code to be rigorously enforced.
         (c)   It shall be the duty of all persons licensed hereunder, upon the demand of the Director, to furnish for their inspection, samples of all cigarettes sold or offered for sale, which samples of cigarettes shall be analyzed by and under the direction of the Director.
