§ 111.18 COMMUNITY MENTAL HEALTH INDEPENDENT LIVING CENTERS.
   (A)   Definition.
      (1)   The term COMMUNITY MENTAL HEALTH INDEPENDENT LIVING CENTER, as used in this section, is defined as a multiple family dwelling used, owned, leased or maintained by any person, firm or corporation, whether for profit or not for profit, providing deinstitutionalized semi- supervised transitional living experience for persons classified as mentally ill and who are motivated for independent living. The term includes living centers established under the Community Mental Health Act (405 ILCS 20) and approved by the Illinois Department of Mental Health and Developmental Disabilities.
      (2)   The term MULTIPLE FAMILY DWELLING is defined as a building designed or altered for occupancy by 3 or more families living independently of each other.
   (B)   Compliance with section and other Village ordinances. No multiple family dwelling in the Village shall be used or maintained as a Community Mental Health Independent Living Center unless such building and every part thereof shall conform to the requirements of this section and to such other requirements of the building, zoning, housing and health ordinances of the Village as may apply.
   (C)   License required. It shall be unlawful for any person to conduct, keep, manage or operate or cause to be conducted, kept, managed or operated a Community Mental Health Independent Living Center without a license therefor. The fee shall be as set forth in § 110.13 (mental health).
   (D)   Application. Applications for license to operate a Community Mental Health Independent Living Center in the Village shall be made in writing to the Director of Finance and shall conform to the requirements set out in Chapter 110 of this Code.
   (E)   General duties of Director of Finance. Upon receipt of the application it shall be the duty of the Director of Finance to submit the application to the Building Director, to the Chief of the Fire Department, to the Chief of the Police Department, and to the Building Director, who shall each authorize the proper inspection, and no license shall be issued until they have received the written approval from each of the officials.
   (F)   General duties of Building Director. The Building Director shall determine that the requirements of the Building Code, Zoning Ordinance, Plumbing Code and Electrical Code of the Village are complied with. They shall also find and determine that all regulations of the Health Department of the Village, including the Village Housing Code, have been complied with.
   (G)   General duties of Chief of Fire Department. The Chief of the Fire Department shall find and determine that all fire hazards have been eliminated from the premises; that the premises have proper and sufficient fire extinguishing equipment; that the premises comply with all regulations and recommendations of Chapter 91 of this Code; and that the occupants of the building have adequate fire protection.
   (H)   Inspections. At least twice a year after the license required in this section has been issued or more often if deemed necessary, and before the renewal of any such license to conduct, keep or operate any Community Mental Health Independent Living Center, it shall be the duty of the Building Director, the Fire Chief, and the Police Chief to authorize the inspection of the premises and determine that the provisions of this Code are being complied with.
   (I)   Violation of section to constitute nuisance. The maintenance or use of any Community Mental Health Independent Living Center in violation of the provisions of this section is declared to be and shall constitute a nuisance and may be abated accordingly by the Building Director or other officer or department head of the Village as provided in §§ 92.20 et seq. or as provided by law.
   (J)   Resident supervisor, record keeping. A licensee shall have a resident program supervisor in charge and control of the premises at all times. The licensee shall require the supervisor to keep and maintain records of the operation of the living center and the names and history of the residents therein. The information contained in such records, being deemed confidential, shall be made available only to Village department heads upon notice and demand.
