§ 99.01 DEFINITIONS.
   For the purposes of this chapter, the following definitions shall apply unless the context clearly indicates or requires a separate meaning. Any term not defined herein shall have the meaning ascribed to it in other ordinances of this Village, and if not defined in any other Village ordinances, it shall have the meaning ascribed in the Illinois Vehicle Code, 625 ILCS 5.
   ABANDONED VEHICLE.
      (1)   A vehicle parked that has been unmoved for a period of at least 24 hours and from its condition, the period during which it has not been moved, or some other circumstance appears to have been abandoned by its owner; or
      (2)   A vehicle parked in a public place or on private property without the consent of the lot owner, proprietor or agent of the property, which person has requested that the vehicle be towed; or
      (3)   A vehicle defined as abandoned, or capable of being towed, by any other ordinances of the municipality, and which does not fall into the categories of "hazardous" or "unlawful" vehicles, and therefore is not subject to an immediate tow; or
      (4)   A vehicle that has been reported stolen;
      (5)   A vehicle that is parked in a location where the parking of the vehicle is not allowed under the provisions of any applicable law, statute, ordinance, rule or regulation; or
      (6)   A "trailer," as defined by 625 ILCS 5/1-209, that is not attached to or drawn by a "motor vehicle," as defined by 625 ILCS 5/1-146, or not attached to or drawn by a "truck," as defined by 625 ILCS 5/1-211.
   CHIEF OF POLICE. The executive head of the Police Department or anyone designated by them to perform the functions prescribed under this chapter.
   HAZARDOUS VEHICLE.
      (1)   A vehicle that has been involved in a collision and is disabled or cannot be immediately moved by the owner or operator of the vehicle; or
      (2)   A vehicle that presents an immediate danger to the health, safety or welfare of the members of the public; or
      (3)   A vehicle abandoned or disabled on a public street, way or alley that is impeding the orderly flow of traffic or poses a potential danger to pedestrians or other operators of vehicles; or
      (4)   A vehicle that must be moved to allow for snow removal from a public street, way or alley.
   INOPERABLE VEHICLE.
      (1)   A vehicle located on a public street, highway, alley or other public way which is incapable of being driven;
      (2)   A vehicle not located in a public way, but which is visible from a public street, sidewalk, highway, alley or other public way which for a period of 5 days has been in such a state of disrepair that it is incapable of being driven.
   OWNER. If a vehicle is registered, then the person in whose name the vehicle is registered. If a
vehicle is not registered, or if registration cannot be determined, then the person who holds legal title to a vehicle.
   TOW SERVICE OPERATOR. A person engaged in the business of, or offering the services of, a vehicle wrecker or towing service, whereby motor vehicles are or may be towed or otherwise moved from 1 place to another by use of a tow truck.
   TOW TRUCK. A truck designed or altered and equipped for and used to push, tow, draw, or otherwise move disabled vehicles by means of a crane, hoist, tow bar, tow line, auxiliary axle, or other means, and to render assistance to disabled vehicles.
   TOWING LIST. A list maintained by the Police Department containing the names of at least 2 but no more than 5 tow service operators licensed by the Village and approved pursuant to this chapter to respond to requests for towing of vehicles by the Police Department or Building and Code Enforcement Department for the towing of vehicles.
   UNLAWFUL VEHICLE.
      (1)   A vehicle that is the subject of a search and seizure by the Police Department;
      (2)   A vehicle parked in violation of a state statute or a Village ordinance which prohibits parking at the location in question or for the period of time for which the vehicle has been parked, and where either the statute or the ordinance authorized the vehicle to be towed and there are signs posted in the general area stating that illegally parked vehicles are subject to being towed;
      (3)   A vehicle parked in such a way that it obstructs access to or the use of a fire hydrant;
      (4)   A vehicle parked in such a way that it obstructs or may obstruct the movement of an emergency vehicle; or
      (5)   A vehicle operated with the permission, express or implied, of the owner of record that is used in violation of 625 ILCS 5/12-503 or 12-611.
      (6)   A vehicle that has been reported stolen or bears license plates that have been reported stolen or belong to a vehicle that has been reported stolen.
      (7)   A vehicle parked on a lot with a vacant building without the written permission of the owner of the lot, and/or without being listed as an authorized vehicle on a list submitted pursuant to §§ 72.25 and 150.031(A)(4) of this Code.
   VEHICLE. Any device in, upon or by which any person or property is or may be transported or drawn, except devices moved by human power, devices used exclusively upon stationary rails or tracks, snowmobiles, and devices not designed for use on public streets or highways. VEHICLES include but are not limited to trucks, automobiles, motorcycles and motor driven cycles.
