311.02 PARADES AND PROCESSIONS.
   (a)    Permit Required; Exception. No person, organization or group of persons shall parade or hold a procession in or upon any of the dedicated or undedicated streets, highways, parks or public grounds in the Municipality unless such person, persons, organization or group of persons first obtains a permit from the Mayor. This section shall not apply to funeral processions.
   (b)    Permit Application; Fee. Any person, group of persons or organization desiring to parade or hold a procession in or upon any dedicated or undedicated street, highway, parks or public grounds, before parading or holding such procession, shall obtain from the Mayor a permit which shall be issued only upon and with the written approval of the Chief of Police or acting head of the Police Department. Each application for a permit shall be made in duplicate in such form as may be prescribed by the Mayor, and each copy shall be signed by the applicant, describing the route over which the parade or procession is to take place. Such application shall be filed at least five days prior to the date of the proposed parade or procession, unless the Mayor, for good cause shown, shortens the required time, and the application shall be accompanied by a fee of one dollar ($1.00).
   (c)    Permit Refusal or Revocation. The Mayor may refuse to issue a permit if he determines that the applicant or group or organization or persons represented by the applicant have previously violated the provisions of a similar permit issued by the Municipality or any other governmental body or have violated any of the ordinances of the Municipality or laws of the State of Ohio or of the United States in connection with a previous parade or procession upon public streets or grounds; or, if by reason of the nature of the proposed parade or procession or of the character and type of the objects to be promoted thereby or for any other reason the Mayor is of the opinion that the granting of such a permit for the proposed parade or procession will result in, provoke or tend to provoke disorderly conduct or create a disturbance, or will result in the violation of the ordinances of the Municipality or laws of the State of Ohio or of the United States.
The permit herein provided for may be revoked at any time by the Mayor for any of the reasons herein set forth for the refusal of the same, provided that notice of such revocation shall immediately be given to the applicant.
   (d)    Driving Through Parades. No driver of any vehicle shall drive between the vehicles or persons comprising a parade or other authorized procession when such vehicles or persons are in motion and are conspicuously designated as a parade or procession. This subsection (d) shall not apply to public safety vehicles.
   (e)    Littering and Damage. The person or organization obtaining a permit for a parade or procession shall be responsible for cleaning up any paper or other litter on the street or public grounds caused by the holding of such parade or procession, and if the permit holder fails to do so he shall be liable for any damage to personal or real property caused by the holding of such parade or procession. If the permit holder fails to clean up litter or to have such damage to property repaired within three days after the date of such parade or procession, then the Municipality may proceed to have the street or grounds or park cleaned or to have damage to real or personal property repaired and the person or organization holding the permit shall be liable to the Municipality for reimbursement for such expense.
