139.01 COMPOSITION.
The following positions are hereby established within the Police Department: Chief of Police, Lieutenant, Sergeant and Patrolman.
139.02 DEPARTMENT RULES AND REGULATIONS.
The Rules and Regulations of the Mayfield Village Police Department, dated November, 1968, and on file with the Clerk of Council, are hereby approved.

139.021 APPOINTEES AND HIREES TERMINATED WITHIN YEAR; TRAINING EXPENSES REIMBURSED.
Contemporaneous with their original appointments to the Police Department, all original full-time appointees and part-time hirees, from and after the effective date of this section, shall execute an agreement, as approved by the Director of Law, with the Municipality such that in the event the appointee or hiree voluntarily terminates his employment with the Municipality within one year following the date of his appointment such appointee or hiree shall reimburse the Municipality for all sums paid to provide the appointee or hiree with the instruction and training required by the Ohio Revised Code to attain the status of police officer. In the event the appointee or hiree fails to reimburse the Municipality as required herein, the Director is hereby authorized to commence a civil action in a court of competent jurisdiction to collect any sums due the Municipality. The agreement to be executed by and between the Municipality and the appointees or hirees as required in this section shall not abrogate any rights accorded such appointees or hirees by the rules and regulations of the Civil Service Commission.

139.03 AUXILIARY POLICE; CREATION AND RULES AND REGULATIONS.
(a) Approval of Establishment. Council hereby approves the establishment of an Auxiliary Police Unit within the Police Department, to work in times of war and other emergency and to train and prepare for such occasions, as part of the civil defense program of the Village, and to exercise all of the powers conferred by Ohio R. C. 737.161, all under the direction of the Chief of Police under the control of the Mayor.
(b) Approval of Constitution, By-Laws and Rules and Regulations. The Constitution, By-Laws and Rules and Regulations governing the Auxiliary Police of Mayfield Village, dated January, 1976, and filed with Council, are hereby approved and made a part hereof insofar as not inconsistent with law.

139.04 DISPOSITION OF PROPERTY HELD BY POLICE DEPARTMENT.
(a) Any property that has been seized in relation to a violation of Ohio R.C. 2981.12 and any contraband in the custody of the Police Department that is subject to the provisions of Ohio R.C. 2981.13 shall be held and disposed of pursuant to Ohio R.C. 2981.12 and any other procedure provided by law. Any other property that has been lost, abandoned, stolen, seized pursuant to a search warrant, or otherwise lawfully seized or forfeited, and that is in the custody of the Police Department, shall be held and disposed of pursuant to Ohio R.C. 2981.11 and any other procedure provided by law.
(b) The Finance Director is hereby authorized and directed to establish a Special Revenue Generic Fund Type which shall be known as the Law Enforcement Fund. Moneys resulting from the retention, sale or other disposition by the Police Department of contraband forfeited pursuant to Ohio R.C. 2981.13(A) shall be accounted for in the Fund after payment of the charges set forth in division (B)(l) through (B)(4) of that section. Moneys from the Fund shall be allocated by Council to the Police Department only, and shall only be expended for any one or more of the following purposes:
(1) To pay the costs of protracted or complex investigation or prosecutions;
(2) To provide reasonable technical training or expertise;
(3) To provide matching funds to obtain federal grants to aid law enforcement;
(4) For such other law enforcement purposes as the Council determines to be appropriate.
(c) Any and all moneys that result from the retention, sale or other disposition of property by the Police Department and that do not qualify to be accounted for in the Law Enforcement Fund, shall be accounted for in the General Fund.
