   772.01 PURPOSE.
   (a)    Purpose. It is the intent of this chapter to recognize the desire of some property owners to rent their property on a short-term basis and establish appropriate regulations to mitigate the disruption that short-term rental properties may have on a neighborhood. This purpose and intent shall govern the interpretation of the entire chapter.
   (b)    Permit Required. Any person desiring to rent their property on a short-term rental basis shall make application for a short-term rental permit pursuant to Section 772.03, and pay the fee as provided in Section 767.772. For the purposes of this chapter, a "Short-Term Rental" means the rental of a single-family residential property or portion thereof used for the purpose of providing lodging for periods of less than 30 days. A Short-Term Rental shall not include a house-swap or home-exchange arrangement.
   (c)    Limitation. No Short-Term Rental shall be permitted to be rented for more than thirty (30) days in each calendar year.

   772.02 CONDITIONS OF APPROVAL OF A PERMIT FOR SHORT-TERM RENTALS.
   (a)    The following conditions of approval shall apply to applications for a Short-Term Rental permit:
      (1)    Local Property Representative. The property owner must designate a Local Property Representative, who must be over the age of eighteen (18) and live within a five (5) mile radius of the Short-Term Rental, who shall be available 24 hours per day, seven days a week, for the purpose of: (a) responding within one hour to complaints regarding the condition, operation, or conduct of occupants of the Short-Term Rental; and (b) taking remedial action to resolve any such complaints. The name, address, e-mail and telephone number of the property owner and Local Property Representative shall be kept on file with the Building Department. The failure to provide contact information, failure to keep the contact information current, failure to respond in a timely manner to complaints, or the occurrence of repeated complaints may result in the suspension or revocation of permit approval and/or civil or criminal penalties.
      (2)    Occupancy. Maximum occupancy of the rental shall be in conformance with Section 1157.03. The property owner shall be responsible for ensuring that the Short-Term Rental is in conformance with maximum occupancy
      (3)    Restrictions on Use. A renter shall not use a Short-Term Rental for a purpose not incidental to its use for lodging or sleeping purposes. This restriction includes, but is not limited to, using the rental for a wedding, banquet, reception, bachelor or bachelorette party, concert, fundraiser, sponsored event, or any similar group activity.
      (4)    Parking. There will be no demand for parking beyond that which is normal to a residential area and no unusual or excessive traffic to and from the Short-Term Rental. Parking must be on-site and is limited to two (2) vehicles.
      (5)    Informational Packet. A packet of information shall be provided to renters, posted conspicuously in the common area of the Short-Term Rental and provided to the Building Department summarizing guidelines and restrictions applicable to Short-Term Rental use, including:
         (i)    Information on maximum occupancy;
         (ii)    Applicable noise and use restrictions;
         (iii)    Location of off-street parking;
         (iv)    Direction that trash shall not be stored within public view, except within proper containers for the purpose of collection, and provision of the trash collection schedule;
         (v)    Contact information for the Local Property Representative;
         (vi)    Evacuation routes;
         (vii)    The renters responsibility not to trespass on private property and create disturbances; and
         (viii)    Notification that the renter is responsible for complying with this chapter and all other applicable laws of the Village and State of Ohio and that the renter may be cited or fined by the Village for violating the provisions of this chapter.
      (6)    Insurance. The property owner shall maintain on file with the Village an up to date certificate of insurance documenting that the Short-Term Rental is insured as a short-term rental for the term of the permit.
      (7)    Compliance with Village Ordinances. All Short-Term Rentals must comply with all Village codes and ordinances.
   (b)    Effective Date and Expiration. A permit obtained under this chapter shall be effective for one year, and shall expire one year from the date the permit is obtained.

   772.03 PERMIT; FEE.
   (a)    No person shall rent their property on a short-term rental basis within the Village, unless he or she is the holder of a permit, which is in full force and effect and issued pursuant to the provisions of this chapter, and shall exhibit such permit to any police officer or official of this Village upon demand.
   (b)    Such permit shall be obtained from the Building Department, and shall furnish the following information:
      (1)    Full name of applicant, phone number, local address, and e-mail address;
      (2)    Permanent home address (if different from local address);
      (3)    Name and contact information of the Local Property Representative as provided in section 772.02; and
      (4)    Proof of insurance as provided in section 772.02.
   (c)    Such applicant shall be issued a permit if the Building Commissioner or his/her authorized representative determines the applicant has satisfied the requirements of this chapter.
   (d)    Any permit granted hereunder may be revoked by the Building Commissioner for furnishing false information in connection with the registrant's application or for the violation of any ordinance of the Village.
   (e)    The sum as set forth in Chapter 767, Fee Schedule at Section 767.772 shall accompany each application for a permit.
   (f)    Every permit shall expire one (1) year after the date of its issuance, but may be renewed in the same manner that it was originally issued.
   (g)    The Building Commissioner shall provide a copy of every permit issued pursuant to this chapter to the Mayfield Village Fire Department and Mayfield Village Police Department.
