1351.02 NOTICE OF VIOLATION.
The Building Commissioner shall cause notice in writing to be given to any person, firm or corporation in violation of Section 1351.01 hereof, requiring such person, firm or corporation to file and cover the unused or abandoned water or gas well in the manner set forth in Section 1351.01 hereof within five days from the date of service of the notice. The notice may be served on the person, firm or corporation to whom it is directed by handing it personally to the person or to a member of the firm or to an officer of the corporation, or by sending it by ordinary mail and addressed to the place of residence or place of business of the person, firm or corporation to whom it is directed, or it may be served in the same manner as is provided by law for the service of summons in civil actions. If such service cannot be obtained, it shall be sufficient to attach a copy of the notice to or to post it on a conspicuous place on the premises or at the site of such abandoned or unused water well.

1351.03 FILLING AND COVERING BY MUNICIPALITY, COSTS A LIEN AGAINST PROPERTY.
If the abandoned or unused water or gas well is not filled and covered in the manner provided in Section 1351.01 within five days after service of the notice, the Building Commissioner shall cause the same to be so filled and covered and the cost thereof shall be paid out of the General Fund of the Municipality, and the owner and occupier of the premises shall thereupon be liable to the Municipality for reimbursement for such expense. Upon failure to make such reimbursement, the amount thereof may be certified by the Finance Director to the County Auditor to be assessed against the property with general taxes and assessments.

1351.99 PENALTY.
Whoever fails within five days after service of notice to fill and cover an unused or abandoned water or gas well of seven inches or more inside diameter, in the manner provided in this chapter shall be fined not more than one hundred dollars ($100.00) and imprisoned not more than five days, or both. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
