1341.12 FENCING; PERMIT; FEE.
   (a)    All swimming pools shall be kept free from any nuisance of any nature. The area shall be fenced in the case of family swimming pools by a fence four feet in height and in the case of public and club swimming pools by a fence or enclosures not less than eight feet high. The entrance to the fenced or enclosed area shall be through a gate of the self-closing type, with an approved lock. All fence posts shall be anchored securely in concrete. All such pools shall at all times be under the supervision of an adult person. The fences shall be of the open or transparent type and shall be approved by the Building Commissioner as to safety and design, but a fence need not be of the open or transparent type nor be required to have a gate of the self-closing type, with an approved lock, if the only means of entrance and access is to or from the dwelling house, but such fence must be in conformity with the architectural design of the house.
   (b)    A permit shall be obtained from the Building Commissioner for the erection of each such fence at a fee as provided in Chapter 1309.

   (c)    From the date construction of the swimming pool commences to the date of installation of the fence required in subsection (b) hereof, the contractor or property owner shall install a snow fence, or other similar fence, around the construction site. There shall be no permit required for the installation of this temporary fence.
