1105.09 VIOLATIONS; REVOCATION OF PERMITS; REINSTATEMENT.
If the Director of Buildings or his or her duly qualified assistant determines that any of the requirements of this chapter have been violated, or that the owner has failed to meet any of the provisions and specifications set forth in his or her preliminary plat or record plat or in any plan that has been submitted by the owner or his or her agent to the officials of the City, then the Director of Buildings shall revoke all permits of every type issued in the name of the City to any such owner. Notice of such violation or noncompliance shall be served immediately upon the owner or his or her agent, superintendent or contractor in charge of the construction or work, or, in the alternative, may be posted upon the premises or area then under construction. Such notice shall give the owner five days in which to correct the violation or deficiency. After a lapse of five days, no person shall perform any work in or about the structure, building or premises, and the Director of Buildings shall post a further notice to such effect upon the premises or in the area under construction.
If required corrections are not made within five days, the contractor shall be required to immediately remove all building material, contractor's equipment or other supplies from the premises, to fill any excavation, ditch or water hole and to effectively protect or remedy any dangerous or unsanitary condition that may exist on the premises, the same to be done within a reasonable time to be fixed by the Director of Buildings. Should the contractor fail to complete the work within the specified time, the Director of Buildings shall cause the same to be done and deduct the expense thereof from any deposit which the owner has placed in the custody of the City.
When the owner has corrected the violation or deficiency, as stated in the notice of the Director of Buildings, all permits which were revoked shall again become effective, subject to performance of the conditions set forth in this chapter.
