1105.07 IMPROVEMENT PROCEDURE; BOND FOR BUILDING PERMIT.
   (a)   Established Grade. The owner's engineer shall submit to the City Engineer, for his or her approval, the suggested established grade. When so approved, it shall be inked in on the improvement plan.
   (b)   Approval of Plans. The plan for water mains and the plan and profile for sewers shall be made in pencil, and blueprints of such plans shall be submitted to the City Engineer, to the County Sanitary Engineering Department and to the Cleveland Department of Public Utilities, Division of Water, as their approval is required.
   After the tentative approval of such agencies has been received, all data pertinent to a complete plan shall be inked in on the tracing cloth plan and the final approval then secured from such agencies. Copies of the approval by the County Sanitary Engineering Department and the Cleveland Department of Public Utilities, Division of Water, shall be filed with the City Engineer. A duplicate set of all improvement plans, made in ink on tracing cloth, shall be filed with the City Engineer before any construction work is begun. Complete specifications shall be approved by the respective agencies and filed in triplicate with the City.
   (c)   Cash Deposit. The owner shall deposit with the City a sum in an amount fixed by the City Engineer to defray all expenses incurred by the City Engineer in checking plans and specifications, all costs of inspection by the City Engineer and the Director of Buildings during construction of the improvements and all costs of damages to existing facilities. If such sum proves to be inadequate, the owner, upon notice to do so, shall deposit an additional amount forthwith. If there is a surplus, it shall be returned to the owner.
   This deposit shall be in the City Treasury before any work is done by the City Engineer to approve the established grade, plans and specifications for all underground improvements.

   (d)   Start of Work; Bond; Building Permits. As soon as the established grade is approved by the City Engineer, the owner may then start grading operations. The City will not permit the piling of topsoil or surplus excavation which would adversely affect neighboring property. As soon as plans and specifications have been approved by the City Engineer, Council, the County Sanitary Engineer and the Cleveland Department of Public Utilities, Division of Water, the owner may start the installation of all underground improvements. When all underground improvements have been completed in any block or street and, in the opinion of the City Engineer, the trenches have settled sufficiently, all surplus shall be removed from the street, the subgrade for the temporary pavement shall be reformed and consolidated and the temporary pavement or roadway shall be built.
   When the temporary roadway has been constructed to permit the ingress and egress of police and fire equipment, and when the house grades of each sublot have been established and approved by the City Engineer and a sum fixed in amount by the City Engineer, for the establishment of the house grades and for the maintenance of the temporary roadway, has been deposited with the City, then building permits will be issued by the City as soon as the owner has filed with the City a surety bond approved as to surety and form by the Director of Law and in an amount fixed by Council sufficient to ensure the construction and completion of sidewalks, driveways, aprons and permanent pavement.
   If the owner wishes to obtain a building permit prior to the completion of construction of all underground improvements, septic tanks, wells, etc., and the temporary roadway, he or she may do so by filing a surety bond, approved as to surety by the Law Director, in an amount fixed by Council as sufficient to ensure completion of all improvements.
