917.12 REMOVAL OR BURNING OF DISEASED TREES OR SHRUBS ON PUBLIC OR PRIVATE PROPERTY.
   If the Director of Public Service, upon inspection, determines that any tree or shrub is infected with any disease, he or she shall, if the tree is in any public street, ground or place, immediately remove and burn it in such a manner as to prevent, as fully possible, the spread of the disease. If the diseased tree is located on private property, the Director shall immediately serve upon the owner of such property a written notice that the tree is infected and that it must be removed and burned under the supervision of the Director within five days of the service of the notice. If the owner cannot be found, a copy of the notice shall be posted upon the infected tree. If the tree is not removed and burned within five days after the service or posting of the notice, the Director shall cause the tree to be so removed and burned. The cost of the removal and burning shall be reported to the owner of the property, if he or she can be found, and also to Council. If the cost is not paid within thirty days of the report, Council may assess the cost as in cases of abatement of other nuisances.
