(a) Whoever violates any of the provisions of this chapter is guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00) for each offense, if an individual, and not more than one thousand dollars ($1,000), if an organization, pursuant to the provisions of Chapter 597 of the General Offenses Code, for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
(b) Whoever is convicted of a subsequent violation of this chapter shall, upon conviction, be deemed guilty of a misdemeanor of the fourth degree and shall be fined not more than two hundred fifty dollars ($250.00) or imprisoned not more than 30 days, or both, if an individual, and not more than two thousand dollars ($2,000), if an organization, pursuant to the provisions of Chapter 597 of the General Offenses Code, for each offense. Such persons shall be deemed guilty of a separate offense for each and every day or portions thereof during which any violation of any of the provisions of this chapter is committed, permitted or continued.
(c) Whoever is convicted of a third or subsequent violation of this chapter shall, upon conviction, be deemed guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months, or both, if an individual, and not more than five thousand dollars ($5,000), if an organization, pursuant to the provisions of Chapter 597 of the General Offenses Code, for each offense. Such persons shall be deemed guilty of a separate offense for each and every day or portions thereof during which any violation of any of the provisions of this chapter is committed, permitted or continued.
