559.05 DUTY TO KEEP SIDEWALKS CLEAN; SNOW REMOVAL; SIGHT OBSTRUCTIONS.
   (a)   It shall be the duty of the owner of each and every parcel of real property in the Municipality, unless zoned residentially, abutting upon any sidewalk, to keep such sidewalk abutting his or her premises free and clear of nuisances, obstructions, snow and ice and to remove therefrom all snow and ice accumulated thereon within a reasonable time, which will ordinarily not exceed 12 hours after the abatement of any storm during which snow and ice may have accumulated.

   (b)   (1)   No person removing snow or causing snow to be removed from any residential or commercial driveway, sidewalk, public or private parking lot or private premises within the City shall deposit the same on the street, pavement or sidewalk of any public street or on any tree lawn in any public street, except the tree lawn immediately in front of the premises from which the snow is removed. In the event that the tree lawn is less than three feet in width or is otherwise inadequate to accommodate the removed snow, then no snow shall be deposited thereon. Such snow being removed shall be deposited in the front or rear yard of the premises. No snow shall be deposited, in any manner, on adjacent properties, including, but not limited to, front yards, back yards or side yards. Snow may only be deposited and must remain on the premises which is being cleared.
      (2)   The height of any such removed snow, as piled, shall not exceed a height that will result in obstructing or otherwise impairing the sight or vision of any pedestrian or driver of a motor vehicle or prevent such pedestrian or driver from safely traversing the driveway, sidewalk, roadway or other pathway of travel immediately adjacent to the premises.
      (3)   The provisions and requirements of this division shall not apply to City-owned and/or operated snow removal equipment operated by City crews in the course of normal and customary City snow removal activities.

   (c)   Whoever violates this section is guilty of a minor misdemeanor, and shall be subject to the penalty provided in Section 597.02.
