517.13 NUISANCE CONDITIONS PROHIBITED.
   (a)   No person shall keep or harbor any animal or fowl in the Municipality so as to create noxious or offensive odors or unsanitary conditions which are a menace to the health, comfort or safety of the public.
   (b)   No person, whether the owner or person in charge or control of an animal, shall permit the animal to destroy or damage any lawn, tree, shrub, plant, building or other property, other than the property of the owner or of the person in charge or control of such animal, by scratching, digging, defecating, urinating or by any other means.
   (c)   The owning, keeping or harboring within the Municipality of any dog or other animal which, by repeated biting, habitual barking or howling, or by repeated violations of division (a) and/or (b) of this section, all of which are a menace to the health, comfort or safety of the public, may be declared to be a nuisance upon proper order by a court before whom any complaint covering such animal is heard.
   (d)   Whoever violates any of the provisions of this section is guilty of a minor misdemeanor of the first offense; for each subsequent offense such person is guilty of a misdemeanor of the fourth degree. The penalty shall be as provided in Section 597.02.
