1383.051 UTILITY SERVICE SHUT-OFF.
   The Mayor or designee is hereby authorized to direct utility service shut-off before the meter for all properties determined by the City's Building Department to be vacant and unsafe.
   (a)   If at any time there is property within the City of Mayfield Heights that has been determined by the City's Building Department to be vacant and unsafe, the Mayor or designee shall contact the appropriate utility company and direct that utility service to that property be shut-off prior to the metering device, subject to utility requirements for notification to property owners of record as required by law.
   (b)   For all purposes of this determination of vacant and unsafe:
      (1)   "Unsafe" means all buildings or structures that are injurious to or a menace to the public health, safety or welfare, or that are structurally unsafe, unsanitary or not provided with adequate safe egress, or that constitute a fire hazard, or are vacant and open to the public, or which are otherwise dangerous to human life or injurious to the public, or in relation to existing use constitute a hazard to the public health, safety or welfare by reason of inadequate maintenance, dilapidation, obsolescence or abandonment. All unsafe structures or conditions are declared to be public nuisances.
      (2)   "Utility" means any company which is in the business of providing electrical, water, gas, sewer, telephone, cable or other utility service to a building or structure.
      (3)   "Vacant" means that no person actually and legally resides in any part of the structure, or that no person conducts a lawful business in any part of the structure.
      (4)   "Shut-off means to stop the flow of electricity, water, gas or other utility service from entering the premises prior to reaching a metering device.
