No person in the City Parks shall conduct himself or herself in the following manners:
(a) Buildings and Other Property.
(1) Willfully mark, deface, disfigure, damage, tamper with or displace or remove any building, tables, benches, railings, paving or paving material, water lines or other public utilities, signs, notices or placards, monuments, stakes, posts or other boundary markers, fences or other structures or equipment, facilities or park property or appurtenances, either real or personal.
(2) Fail to cooperate in maintaining restrooms in a neat and sanitary condition.
(3) Dig or remove any soil, sand, rock, stones, trees, shrubs or plants, down timber or other wood or materials or make any excavation by tool, equipment, blasting or other means or agency unless expressly requested to do so by the proper City of Mayfield Heights authority.
(4) Except on special written permission of the Mayor, erect any building or structure of any kind, or run or string any public service utility into, upon or across such lands.
(b) Trees, Shrubbery and Lawns.
(1) Damage, cut, carve, transplant or remove any tree or plant or injure the bark or pick the flowers or seeds of any tree or plant, nor shall any person attach any rope, wire or other object to any tree or plant. No person shall dig or otherwise disturb grass areas or walk upon any area posted with a sign to "keep off."
(2) Climb any tree or walk, stand or sit upon monuments, vases, fountains, railings, fences or other property not designated or customarily used for such purposes.
(c) Water, Pools and Grounds.
(1) Throw, discharge or otherwise place or cause to be placed in the waters of any fountain or pool any substance, matter or thing, liquid or solid, which will or may result in the pollution of such waters.
(2) Dump, bring in, deposit or leave any bottles, broken glass, ashes, paper boxes, cans, dirt, rubbish, waste, garbage, refuse or other trash, except such may be deposited or placed in proper receptacles where provided. When receptacles are not so provided, all such rubbish or waste shall be carried away from the park by the person responsible for its presence, and properly disposed of elsewhere.
(d) Motor Vehicles, Bicycles and Scooters.
(1) Drive, operate or ride a motor vehicle of any kind, including motor scooter or motorized bicycle within the grounds of any City Park except through the duly designated entrance-ways into the lots set aside for parking.
(2) Leave any bicycle lying on the ground, walks, and drives or set against trees, or in any place where persons may trip over or be injured by them.
(e) Behavior.
(1) Enter the City Parks in an intoxicated condition. Bring any intoxicating beverage into the City Parks. For the purposes of this section, the entire right of way adjacent to all City Parks shall be considered within the City Parks. When intoxicating beverages are stored or transported in a motor vehicle, the driver of such vehicle, all passengers therein and all persons who have been transported therein to the City Parks shall be presumed to be in possession of such beverages.
(2) Expose or offer for sale any food, beverage, ice cream, frozen dessert or any other edible article or thing unless such person is a concessionaire duly licensed by the proper City of Mayfield Heights authority.
(3) Set off, explode or cause to be exploded fireworks, firecrackers or any other explosives, unless prior written permission of the Mayor has first been obtained, which permission may be granted only for events open to the general public of the City of Mayfield Heights.
(4) Loiter or protractedly lounge on the seats, benches or other areas or engage in loud, boisterous, threatening, abusive, insulting or indecent language or behavior, or engage in any disorderly conduct or behavior tending to a breach the public peace.
(5) Disturb or interfere with any person using any recreation facilities or park area under authority of a permit.
(6) Enter any area or building posted as "closed to the public."
(f) The Recreation Director, Safety Director, City Council (or a proper designee of the Recreation Director or Safety Director) are authorized to make and establish additional rules and regulations not otherwise provided for, and not inconsistent with, the provisions of this chapter, as he or she may deem necessary to protect the public in the use of the City Parks and facilities located therein and/or to protect and preserve such City Parks and facilities.
