307.03 QUALIFICATIONS FOR CLASS A TOWING LICENSE.
   (a)   License Application.
      (1)   The application for a Class A license shall be made to the Mayor or Chief of Police upon such forms as shall be prescribed by said office. Each application for license or renewal of license shall include a filing fee of fifty dollars ($50.00) for the initial license and twenty-five dollars ($25.00) for each annual renewal of the license fee for the Class A license. The license year shall commence on April 1 and expire on March 31 of the succeeding year.
      (2)   The applicant, at the time of filing the application, shall furnish a certificate of insurance or an acknowledgment thereof, by an insurance carrier licensed to do business in the State, evidence of a garage keeper's legal liability to protect property left in his care, custody or control in an amount not less than fifty thousand dollars ($50,000) and general liability in an amount not less than one hundred thousand dollars ($100,000). In addition thereto, evidence of public liability and property damage insurance coverage in an amount of not less than three hundred thousand dollars ($300,000) per person coverage and three hundred thousand dollars ($300,000) per occurrence shall be provided. For heavy duty tows, evidence of a garage keeper's legal liability to protect property left in his b care, custody or control in an amount not less than three hundred thousand dollars ($300,000), general liability in an amount not less than five hundred thousand dollars ($500,000) in addition thereto, evidence of public liability and property damage insurance coverage in an amount not less than five hundred thousand dollars ($500,000) per person coverage and five hundred thousand dollars ($500,000) per occurrence. Such policy shall provide that it shall not be terminated until after at least ten days' notice shall have been given by the company issuing such policy in writing to the Mayor or Chief of Police. The policy shall indemnify the City, its officers, agents and employees and any and all third persons from loss or damage, by reason of any negligent or unlawful act omitted or performed by the applicant, its agents or servants in conjunction with the towing of any vehicle in response to a police call.
      (3)    In addition to the foregoing, the applicant for a license including any partner or limited partner of a limited partnership and any officer of director of a corporate applicant, shall furnish the following information.
         A.    Business Name and address, and the Name and address of the principal owner,.
         B.    The location of the premises for which the license is requested.
         C.    The length of time applicant has been engaged in business in the City.
         D.    Telephone numbers of the applicant and business telephone numbers currently in use.
         E.    The applicant's physical description, including height, weight, color of eyes and hair and date of birth.
         F.    The business, occupation or employment of the applicant for the three years immediately preceding the date of the application.
         G.    The business history of the applicant regarding previous licenses obtained or refused from any governmental agency, including revocations and suspensions and the reasons there for.
         H.    Criminal history information, including date, time and place of convictions for all violations except traffic offenses.
         I.    If the applicant is a corporation or a partner of a partnership that is incorporated, the name of the corporation shall be set forth exactly as shown on the articles of incorporation, and a copy of the Articles shall be included, along with a Certificate of Good Standing from the Ohio Secretary of State.
   (b)    Qualifications. No applicant shall be licensed hereunder unless he maintains twenty-four hour service and provides for the release of cars to their owners from 8:00 a.m. to 8:00 p.m. Monday-Saturday; Sunday 12:00-5:00 p.m. Each applicant must provide telephone communications with the Police Communications Center twenty-four hours daily, and shall also have available two approved tow vehicles or tow trucks. All applicants must provide approved storage facilities for a minimum of twenty vehicles outside and three vehicles inside at its principal place of business as hereinafter provided. Licensee must maintain said storage facility within 10 miles of the Maumee City limits to be eligible for said license. In order to qualify for heavy towing service, an applicant must indicate on his application that he intends to provide such services and the license issued shall indicate that the licensee has additional storage for two semi-tractors and trailers at its principal place of business or an approved premises used exclusively for heavy duty towing. Tow trucks or two vehicles that are leased must be leased by the year, and a copy of the lease is to be placed on file with the Police Division. Tow trucks or tow vehicles that are leased must be used exclusively by the lessee and maintained at his premises.    No person shall be licensed who has had two or more theft convictions or any felony conviction within the last ten years immediately preceding application.
