As used in this Article:
(a) "Unavailable" means either that a vacancy in office exists and there is no deputy authorized to exercise all of the powers and discharge the duties of the office, or that the lawful incumbent of the office and his duly authorized deputy are absent or unable, for physical, mental or legal reasons, to exercise the powers and discharge the duties of the office.
(b) "Emergency" means:
(1) Any imminent threat or actual occurrence of widespread or severe damage to or loss of property, personal hardship or injury, or loss of life that results from any natural phenomenon or act of a human; any attack, either actual or imminent, or a series of attacks by an actual or potential enemy of the United States, whether foreign or domestic, or by a foreign nation upon the United States that causes or may cause substantial damage to or destruction of life, property, or the environment within the United States or that is designed to injure the military or economic strength of the United States. "Attack" includes, without limitation, acts of sabotage, acts of terrorism, invasion, the use of bombs or shellfire, conventional, nuclear, chemical, or biological warfare, and the use of other weapons or processes; or
(2) An occurrence or imminent threat of an epidemic, illness, or other health condition that poses a high probability of a large number of deaths, serious or long-term disabilities, or widespread exposure to an infectious or toxic agent that poses a significant risk of substantial physical harm to a large number of people in the City of Maumee.
(c) "Duly authorized deputy" means a person who is authorized by this Charter or by ordinance to perform all of the functions, exercise all of the powers, and discharge all of the duties of an office in the event the office is vacant or at such times as it lacks administration due to the absence of the incumbent officer.
(d) (Former subsection (d) was removed at the November 8, 2022 election.)
(e) “State of emergency" means any period during which the President of the United States, the Governor of the State of Ohio, the Mayor of the City of Maumee, or the Board of Health having jurisdiction over the City of Maumee has declared or proclaimed that an emergency exists within the City of Maumee.
