107.07 CURFEW.
       (a)   In the event that the Mayor finds it necessary in order to preserve the public safety and good order of the community in times of public emergency declared pursuant to Section 107.02 (a), riots, and civil disturbances, he may declare and establish a curfew prohibiting the physical presence of anyone upon the public streets, parks, and public places in the City.
   (b)   In the event that the Mayor deems it necessary to issue a curfew order, he shall do so by issuing a proclamation setting forth the time and the circumstances of such curfew order, and the ages of persons to be subject thereto, and shall publicize such proclamation by use of the public news media and shall post the same in conspicuous places in public buildings.
   (c)   In the event that the Mayor issues such a proclamation of curfew, any police officer of the City, or any peace officer acting under the direction of the Mayor or any other duly authorized agents, shall have the right to stop any persons subject to the curfew and to inquire of such persons proof of their age, their destination and purpose for being upon the public streets, parks, or places of the City, to determine if such persons are subject to the curfew.
   (d)   No person who is subject to any curfew proclamation issued in accordance with this chapter shall be in or found upon any of the streets, highways, alleys, parks, or other public places of the City. (Ord. 061-2022. Passed 12-19-22.)
