966.145 VARIANCES FROM WOODLAND REGULATIONS.
   (a)   The Director may grant a variance to any provision of Section 966.143 where such regulation would impose an unreasonable hardship upon the owner of the property, or where disease, damage, or age of the trees, understory, or forest products presents a risk of physical harm to persons, property or other trees or vegetation.
   (b)   A denial by the Director of any request for a variance under this section may be appealed to Council, which may grant the variance only if it finds that such regulation would impose unreasonable hardship upon the owner of the property, or that disease, damage, or age of the trees, understory, or forest products presents a risk of physical harm to persons, property or other trees or vegetation.
