(a) At the time that an owner of a particular price of property applies for an occupancy certificate for a structure, it is required that a street tree bond be posted, in an amount determined by the Director, to ensure the placement of street tree(s) for that property.
(b) The bond shall further provide for payment to the City or to persons entitled thereto, of the cost and expense of purchasing and installing the required street tree for the subject property. Such bond shall be further conditioned that such surety shall indemnify and save harmless the City or any person acting on behalf of the City, on account of any and all claims for damages or injuries to persons or property due to incidents arising from the installation of the tree where such installation is being done in a condition which is safe and fit, and in compliance with the provisions of this chapter and amendments thereto or any ordinance, rules or regulations relating to public safety now in effect or which may hereinafter be enacted or promulgated.
(c) In the event the property owner provides evidence that he has caused such required street tree to have been properly planted prior to the installation of same by the City, the bond shall be released to the property owner.
