529.04 LIQUOR CONSUMPTION OR OPEN CONTAINER IN MOTOR VEHICLE.
   (a)   As used in this section, "street", "highway" and "motor vehicle" have the same meanings as in Ohio R.C. 4511.01.
   (b)   No person shall consume any beer or intoxicating liquor while occupying, operating or being a passenger in or on any motor vehicle, moving or stationary, on any street, highway or other public or private property open to the public for purposes of vehicular travel or parking.
 
   (c)   No person shall possess an opened container of beer or intoxicating liquor while occupying, operating or being a passenger in or on any motor vehicle, moving or stationary, on any street, highway or other public or private property open to the public for purposes of vehicular travel or parking, unless the opened container of beer or intoxicating liquor is stored in a place which can be reached only by leaving the motor vehicle.
 
   (d)   Whoever violates subsection (b) hereof is guilty of a misdemeanor of the fourth degree. Whoever violates subsection (c) hereof is guilty of a minor misdemeanor.
