§ 70.02 TRUCK ROUTES.
   (A)   The City Council shall from time to time designate such truck routes within the city as may be necessary to protect city streets from damage by excessive weight and for the proper flow of traffic through the city. Streets designated as truck routes shall be identified as such by proper signs at reasonable intervals.
   (B)   The actual streets designated as truck routes can be found in Ch. 71, Sch. II.
   (C)   It shall be unlawful for any person, firm, corporation or other entity to use, travel upon or drive over any street, avenue or highway within the city not designated as a truck route, any truck or other vehicle having a gross vehicular axle weight rating over 12,000 pounds, except trucks delivering food produce to businesses or schools and trucks delivering construction materials to business or home construction sites; provided, however, such a truck or vehicle may be driven if such truck route provided that the driver thereof first secures a permit from City Hall and takes the designated route.
   (D)   By acceptance of a permit to operate an overweight vehicle upon a city street not designated as a truck route, or by operation of an overweight vehicle upon such streets without first obtaining a permit when one is required, the driver and operator of such an overweight vehicle shall be deemed to accept full financial responsibility and liability for any and all damages which may be caused to such city streets because of the excessive weight placed thereon.
   (E)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      OVERWEIGHT VEHICLE. Any vehicle which exceeds the weight rating specified in division (C) above at the time it passes upon a city street not designated as a truck route.
      OPERATOR. The person, corporation or other entity which causes the vehicle to be operated upon the city’s streets or which employees or compensates the driver thereof.
