If any person discharges sewage, industrial wastes or other wastes into the city POTW contrary to the provisions of this article, federal or state pretreatment requirements, or any order of the city, such discharge is declared to be a public nuisance and a nuisance per se. The city attorney may commence an action for appropriate legal, injunctive and/or other equitable relief in any court of competent jurisdiction, or an action for civil or criminal penalties in the county district court.
