Sec. 70-38. Warning of street opening.
Any person to whom a permit is issued shall be responsible for making any opening in any street, alley or public place under this article and shall himself, or by his agent, provide an adequate warning of such opening, at all times, for the protection of the safety of the public. Before refilling such opening or excavation, notice shall be given to the director of public works, who shall immediately cause an inspector to supervise the refilling of such opening or excavation; and such refilling shall not proceed until the director of public works or his inspector shall be present. Any person making or causing to be made any opening or excavation in any street, alley or public place shall, as speedily as possible, repair, refill and put the street, alley or public place in as good condition as before; provided, that in case of a paved street, alley or public place, such refilling shall be made only to the subgrade, and repairing and replacing of such pavement shall be made by the director of public works or his assistant. All such work shall be performed under the supervision of the director of public works or his inspector, and as he shall direct and to his satisfaction.
