Sec. 42-98. Assaulting or assaulting and battering any individual.
(a)   No person shall assault or assault and batter any individual.
(b)   This section does not apply to:
   (1)   An individual who commits an offense described in MCL 750.81(2).
   (2)   Any assault offense described under state statute that carries penalties higher than 93 days in jail and/or a fine of $500.00.
   (3)   An individual using necessary reasonable force in compliance with section 1312 of the revised school code, 1976 PA 451, MCL 380.1312.
(c)   It shall not be a defense to a charge brought under this section that the defendant committed or intended to commit an offense carrying greater penalties than 93 days in jail and/or a fine of $500.00.
(d)   A person who violates this section is punishable by 93 days in jail, a fine of $500.00, or both.
