§ 72.40 OFFICERS AUTHORIZED TO REMOVE VEHICLES.
   (A)   Whenever any police officer finds a vehicle in violation of any of the provisions of §§ 72.10, 72.11 or 72.12 or any other applicable section of this traffic code or ordinance of the village, the officer is authorized to tow the vehicle or cause the vehicle to be towed or otherwise move the vehicle, or require the driver or other person in charge of the vehicle to move the same, to a position off the roadway.
   (B)   Any police officer is authorized to remove or cause to be removed to a place of safety any unattended vehicle illegally left standing upon any highway, bridge, causeway, or in a tunnel, or in a position or under circumstances as to obstruct the normal movement of traffic.
   (C)   Any police officer is authorized to remove or cause to be removed to the nearest garage or other place of safety any vehicle found upon a highway when:
      (1)   Report has been made that the vehicle has been stolen or taken without the consent of its owner; or
      (2)   The person or persons in charge of the vehicle are unable to provide for its custody or removal; or
      (3)   The person driving or in control of the vehicle is arrested for an alleged offense for which the officer is required by law to take the person arrested before a proper magistrate without unnecessary delay; or
      (4)   The registration of the vehicle has been suspended, cancelled, or revoked.
   (D)   Administrative fee. Prior to the release of a motor vehicle towed pursuant to the provisions of §§ 72.10, 72.11, 72.12 , 72.40(C)(3), and 72.40(C)(4), the owner or other person entitled to possession of the motor vehicle shall pay an administrative fee in the amount of $100 to the Village of Maryville. The appropriate fee shall be paid at the Village of Maryville Police Department.
   (E)   It shall be the duty of the towing and storage company in possession of the towed vehicle to obtain documentation issued by the Village of Maryville Police Department confirming compliance with the foregoing requirements prior to releasing the motor vehicle. The towing or storage company shall be entitled to receive a fee to cover the cost of removing and storing said motor vehicle, from the owner or person entitled to possession of any such motor vehicle, prior to release of the motor vehicle.
