§ 33.105 APPARATUS AND EQUIPMENT.
   (A)   The Village Board shall determine with the advice and counsel of the Fire Chief, the amount, type and size of all fire apparatus and equipment comprising the Fire Department, and shall purchase, repair or replace any and all fire apparatus and equipment and accessories they deem necessary as provided by state law.
   (B)   In addition:
      (1)   The Village Board shall designate and provide safe and convenient housing for all fire apparatus and equipment.
      (2)   The Village Board shall establish suitable arrangements for notifying all personnel of the Department of alarms of fire or emergency and it is incumbent upon all firefighters to arrange for forwarding alarms to themselves when they are called away from home or their place of business.
      (3)   No person shall use any fire apparatus or equipment of the village for any private purpose; nor shall any person willfully and without proper authority take away or conceal any article used in any way by the Fire Department.
      (4)   Calls for fire-aid from neighboring communities necessitating any response of any apparatus or manpower of the Department shall have the consent of the Mayor, or the Fire Chief or, in case neither can be contacted, the next subordinate officer of the Department, before response may be made beyond the Department’s jurisdiction, unless the calls for aid are made pursuant to mutual aid agreements entered into by the Village Board.
      (5)   The Mayor is hereby authorized, with the approval of the Village Board, to enter into agreements with contiguous fire protection districts, properly formed under state law and adjacent municipalities; provided, the agreements shall specify that the officer-in-charge of the Fire Department shall have the authority to refuse response to the calls, if, in his or her judgment, the absence of fire apparatus would unduly endanger the protection of the village.
