(a) No person shall, without privilege to do so, knowingly enter or remain on the following described lands owned by the City between the hours of 10:00 p.m. and 6:00 a.m. local time: the property of the City and commonly known as the City park which is bounded on the west by the South Zane Highway street right of way, on the south by the Grant Avenue street right of way, on the north by the northerly curb of the paved utility roadway which lies to the south of the Fodor Park and north of the herein described lands, and on the east by a chain link fence situated on the west side of the Municipal swimming pool property and the miniature golf course.
(b) Privilege to enter upon such premises or to remain thereon between the hours of 10:00 p.m. and 6:00 a.m. local time, may be granted by the Mayor or his designee, by written consent, to those individuals or organizations whose purpose is charitable in nature.
(c) It is no defense to a charge under this section that the offender was authorized to enter or remain on the land or premises involved when such authorization is secured by deception.
(d) Whoever violates this section is guilty of criminal trespass, a misdemeanor of the fourth degree.
