709.07 SIGNS DEFINED.
   For the purposes of this article, the following terms shall have the meanings ascribed to them by this section:
   (a)   "Downtown area" means that portion of the City of Martinsburg, West Virginia, bounded as follows:
      Beginning at the intersection of North Queen Street and the southern side of the Baltimore and Ohio Railroad main line; thence southeasterly with the Baltimore and Ohio Railroad main line to East Burke Street; thence westerly with East Burke Street to Water Street; thence southerly with Water Street; thence westerly with East South Street to South Queen Street; thence continuing westerly with West South Street to South Maple Avenue; thence northerly with South Maple Avenue to West Burke Street; thence continuing northerly with North Maple Avenue to Exchange Place; thence easterly and southeasterly with Exchange Place to the place of beginning.
   (b)   "Projecting sign" means a sign which is affixed to any building wall or structure and extends beyond the building wall, structure, building line or property line more than twelve inches.
   (c)   "Sign" means any structure, part thereof, or device attached thereto or painted thereon or represented thereon or any material or thing, illuminated or otherwise, which displays or includes any numeral, letter, word, model, banner, emblem, insignia, device, trademark or other representation used as, or in the nature of, an announcement, advertisement, direction, or designation of any person, firm, group, organization, place, commodity, product, service, business, profession, enterprise, or industry, which is located upon any land, or on any building excluding the windows thereof in such manner as to attract attention from outside the building. The flag, emblem, insignia, poster or other display of a nation, political unit, educational, charitable, religious, or similar group, campaign, drive, or event, other than political party or candidate for election to any office or position, shall not be included in this definition.(Passed 5-7-70.)
   (d)   “Commercial off-premise sign” means a business sign, excluding real estate signs under four (4) square feet, which directs the attention of the public to a business, activity conducted, or product sold or offered at a location not on the same premises where such business sign is located. For purposes of this article, easements and other appurtenances shall be considered to be outside such platted parcel of land and any sign located or proposed to be located in an easement or other appurtenance shall be considered an off-premise sign.
