If any person unlawfully, but not feloniously, takes and carries away, or destroys, injures or defaces any property, real or personal, not his own, he shall be guilty of a misdemeanor, and, upon conviction, shall be fined not exceeding one hundred dollars ($100.00), and may, in the discretion of the court, be confined in jail not exceeding thirty days.
