365.13 FINES.
   (a)   Expired Meters: Any person violating the provisions of this article shall pay a fine of ten dollars ($10.00) when the notice is presented to City Hall within seven (7) calendar days after the placing of a notice relative to a parking meter violation on the vehicle in question by meter attendant(s) or an officer of the Police Department. Any person violating the provisions of this article shall pay a fine of twenty-five dollars ($25.00) when the notice is presented to City Hall more than seven (7) calendar days and less than thirty (30) calendar days, after the placing of a notice relative to a parking meter violation on the vehicle in question by meter attendant(s) or an officer of the Police Department. Any person violating the provisions of this article shall pay a fine of fifty dollars ($50.00) when the notice is presented to City Hall more than thirty (30) calendar days after the placing of a notice relative to a parking meter violation on the vehicle in question by meter attendant(s) or an officer of the Police Department. The meter attendant issuing the notice shall, after sixty (60) calendar days have expired, and the owner or operator of having failed to appear and to pay, shall execute a complaint, and a warrant shall then be served by a member of the Police Department charging such owner of such vehicle with failure to pay the penalty within the sixty (60) day period. Any owner or operator of the vehicle who shall have failed to pay the penalty within the sixty days shall be subject to a fine of not less than ten dollars ($10.00) nor more than fifty dollars ($50.00), in addition to fines already due and owing.
   (b)   Accessible parking violations (ADA) (W. Va. Code § 17C-13-6); first Conviction - two hundred dollars ($200.00); second conviction - three hundred dollars ($300.00); subsequent convictions - five hundred dollars ($500.00).
   (c)   All other violations contained in Article 361 : Any person violating the provisions of this article shall pay a fine of fifty dollars ($50.00) when the notice is presented to City Hall within seven (7) calendar days after the placing of a notice relative to a parking meter violation on the vehicle in question by meter attendant(s) or an officer of the Police Department. Any person violating the provisions of this article shall pay a fine of seventy-five dollars ($75.00) when the notice is presented to City Hall more than seven (7) calendar days and less than thirty (30) calendar days, after the placing of a notice relative to a parking meter violation on the vehicle in question by meter attendant(s) or an officer of the Police Department. Any person violating the provisions of this article shall pay a fine of one-hundred twenty-five dollars ($125.00) when the notice is presented to City Hall more than thirty (30) calendar days after the placing of a notice relative to a parking meter violation on the vehicle in question by meter attendant(s) or an officer of the Police Department. The meter attendant issuing the notice shall, after sixty (60) calendar days have expired, and the owner or operator of having failed to appear and to pay, shall execute a complaint, and a warrant shall then be served by a member of the Police Department charging such owner of such vehicle with failure to pay the penalty within the sixty (60) day period. Any owner or operator of the vehicle who shall have failed to pay the penalty within the sixty days shall be subject to the general penalties stated in Section 361.99 , in addition to fines already due and owing.
