(a) Authority of Police. When any Police Officer, Meter Attendant or Police Department employee of the City finds on a City street a vehicle which has in the past been cited for a traffic violation including overtime parking violation and which violations has not been disposed of in the Municipal Court in accordance with the Ordinance pertaining thereto or a vehicle owned by a person which has in the past been cited for a traffic violation including overtime parking violation, which has not been disposed of in the Municipal Court in accordance with the Ordinance pertaining thereto or which vehicles have been in violation of the provisions of this chapter, and the Police Officer, Meter Attendant or Police Department employee deems it necessary, in order to enforce such provisions, that an immobilizer be used, then such Police Officer, Meter Attendant or Police Department employee may immobilize such vehicle by installing or attaching a device thereto until the owner or driver thereof has satisfied any existing and past violations in accordance with the Ordinance pertaining thereto.
(b) Notice. Whenever any such vehicle is so immobilized, a notice in writing, on a form to be prescribed by the Police Chief, shall be conspicuously affixed to such vehicle advising the owner or driver thereof that such vehicle has been immobilized for violation of the City Ordinances enumerated thereon, and indicating the procedure to obtain the release of such immobilizer.
(c) Moving Vehicle Prior to Obtaining Release Prohibited. It shall be unlawful for any unauthorized person to move any vehicle immobilized pursuant to Section 303.07
prior to obtaining release thereof from the Judge of the City Municipal Court or from the shift commander at the City Police Station.
(d) Additional Fine. The owner or driver of any vehicle which had been immobilized shall in addition to the fines and penalties provided for under the provisions of this Chapter, pay a fine of fifty dollars ($50.00) before releasing such vehicle.
(e) Provisions of this Section. If any provision of this Section and any subsections thereof, or their application to any person or circumstance be held invalid, such invalidity shall not affect other provisions or applications of this Article, and to this end the provisions of this Article are declared severable.
