171.14 CHIEF MAGISTRATE, MAGISTRATES AND COURT CLERKS.
   (a)   In the absence of the Municipal Court Judge and the Chief Magistrate, Magistrates and Municipal Court Clerks may act as Municipal Court Judge; provided, that the Chief Magistrate, Magistrates and Municipal Court Clerks shall comply with the requirements set forth in of West Virginia Code § 8-10-2(a) and further shall be required to execute the proper oath of office.
   (b)   Pursuant to West Virginia Code § 8-10-4, authority is hereby vested in the Chief Magistrate and Magistrates to issue warrants for arrest, to administer oaths and to accept and approve sureties and bonds, in the absence of the Municipal Court Judge.
   (c)   The appointment of the Chief Magistrate and Magistrates to perform the aforementioned duties shall be confirmed by Council.
   (d)   Once appointed and confirmed to perform the aforementioned duties, to issue warrants for arrest, to administer oaths and to accept and approve sureties and bonds shall only be removed by action of Council. (Ord. 2014-02. Passed 2-13-14.)
