171.12 ADDITIONAL POLICE COURT JUDGES.
   (a)   There is hereby created in the City the office of Police Court Judge I, Police Court Judge II, and Police Court Judge III, all of whom shall have identical duties and legal authority. Council shall appoint such Police Court Judges as it deems necessary, but shall not be required to appoint one or two or all three of such Judges, or any of them. Each of such Judges must be a resident of Berkeley County, but is not required to be an attorney at law. Such judges shall serve at the pleasure of Council. The Judges appointed herein are in addition to the Police Court Judge for the City appointed under the provisions of Section 171.01.
   (b)   The Police Court Judges I, II and III appointed under the provisions of subsection (a) hereof shall have the same jurisdiction, duties, and authority of the Police Court Judge for the City, with the exception that such Police Court Judges I, II, and III shall not have authority or jurisdiction to hold or preside at trials to determine the guilt or innocence of any person. Such Police Court Judges shall have the authority and jurisdiction to conduct arraignments and to perform any other duties as set forth in Martinsburg City Code, Chapter 18, Article II, except as restricted and modified under subsections (a) and (b) hereof.
   (c)   Council shall determine the rate of pay and is authorized to pay any of such Police Court Judges I, II and III such rate of pay.
