147.03 LIBRARY BOARD MEMBERSHIP; TERMS; VACANCIES.
   (a)   The operation of the Martinsburg Public Library shall be under the authority and jurisdiction of a board of library directors who shall be known as the Martinsburg-Berkeley County Public Library Commission. The directors shall be chosen from the citizens at large of the City with reference to their fitness for such office, in their terms of office shall be for a term of five years from the first day of July following their appointment, and until their successors are appointed and qualified; provided, however, that upon their first appointment under this section a proportionate number shall be appointed for one year, for two years, for three years, for four years, and for five years; and thereafter all appointments shall be for terms of five years. Vacancies in the Board shall be immediately reported by the Board to Council and filled by appointment in like manner, and if an unexpired term for the remainder of the term only. PROVIDED, that after July 1, 2017, the members of the Board of Directors as their terms expire shall be appointed in the following manner. The Board shall consist of five members, two of which shall be appointed by City Council for terms of five years, two of which shall be appointed by the County Council for terms of five years and one of which shall be appointed by the Board of Education for a term of five years. The directors shall be chosen from the citizens at large of Berkeley County with reference to their fitness for such office, in their terms of office shall be for a term of five years from the first day of July following their appointment, and until their successors are appointed and qualified. PROVIDED FURTHER when the next vacancy on the Board is created, the Berkeley County Council shall have the right to appoint the next two members, the Board of Education shall appoint the third and the Martinsburg City Council shall appoint the remaining two members. Vacancies in such Board occurring otherwise than by expiration of term shall be filled for the unexpired term in the same manner as original appointments, by the entity having been designated the appointment of the member whose absence has created the vacancy.
   (b)   Members of the Library Commission may be removed for just cause in the manner provided by the by-laws of the Library Board.
   (c)   No compensation shall be paid or allowed any member of the Library Commission. (Ord. 2017-05. Passed 5-11-17.)
