(a) Any aggrieved person, having been denied a permit under the terms and conditions of this article, or by the revocation of a permit after one has been issued, may present an amended request, which will be reviewed as a new request and must meet all heretofore conditions and deadlines
(b) The decision of the City Manager or designee may be appealed to the Martinsburg City Council and the decision of the Martinsburg City Council may be appealed to the Circuit Court of Berkeley, in accordance with the laws of the State of West Virginia.
(c) In any appeal under this section, the City of Martinsburg shall have the burden of demonstrating that the denial of the permit was justified under the terms and conditions of this ordinance. (Ord. 2023-12. Passed 8-10-23.)
