(a) In addition to other fees and charges, and in order to offset the cost of essential municipal services made necessary by residential development, there shall be a community development fee charged prior to the issuance of a use and occupancy permit for all residential development in the City of Martinsburg.
(b) For residential development, the community development fee shall be fifty cents ($.50) per square foot for each new housing or dwelling unit. Housing or dwelling unit is defined as one or more rooms in a residential building or in a mixed use building which are arranged, designed, used or intended for use by one or more person living together and maintaining a common household, and which include lawful cooking space and lawful sanitary facilities reserved for the occupants thereof.
