1751.03 GENERAL ORDINANCE ENFORCEMENT.
   (a)   The City Planner shall be responsible for and shall supervise the enforcement of any and all other ordinances and resolutions of Council that deal in any manner with construction, renovation, zoning, or are in any way related to the State Building Code, Planning and Zoning Ordinances, and in addition, shall supervise the application of the laws of the State of West Virginia insofar as the same apply to the City.
   (b)   (1)   The City Planner shall receive applications required by the State Building Code, issue permits and furnish the prescribed certificates of occupancy. He shall examine premises for which permits have been issued and shall make necessary inspections to see that the provisions of law are complied with and that construction is prosecuted safely. He shall enforce all provisions of the building code. He shall, when requested by proper authority, or when the public interest so requires, make investigations in connection with matters referred to in the building code and render written reports on the same. To enforce compliance with law, to remove illegal or unsafe conditions, to secure the necessary safeguards during construction, or to require adequate exit facilities in buildings and structures, he shall issue such notices or orders as may be necessary.       (2)   Enforcement shall include the right and authority to issue citations for violations of the West Virginia Building Code as adopted by the City of Martinsburg and as amended from time to time by the City. The City Planner is authorized to designate an employee within the City Planner’s office as the City Planner’s deputy, which deputy shall exercise all powers of the Code Official/City Planner during the temporary absence or disability of the Code Official/City Planner.
