(a) All persons within the City not served by the City Curbside Recycling Program shall source separate and arrange for the collection for recycling of all designated recyclables upon adoption of this article.
(b) Designated recyclables for the mandatory commercial and institutional source-separation program shall consist of the following materials:
(1) Glass containers, cans, plastics.
(2) Newspapers
(3) High-Grade Office Paper shall include paper items gathered by offices and/or commercial entities. This may include white computer paper, white copier paper, white typing paper, white letterhead paper, white note pad paper, and other similar office paper.
(4) Corrugated cardboard.
(5) Aluminum
(6) Other recyclable materials as designated by the City Council at all times thirty (30) days after said designation and publication of notice in a newspaper of general circulation within the City.
(c) The arrangement for collection of designated recyclables for disposition hereunder shall be the responsibility of the person who generates the recyclables ("generator") or the person contractually obligated to the generator to arrange for collection and disposal of its solid waste. The location of any business or institution within the City limits will be the determining factor for the recyclable collection schedules established by the City Manager.
(d) For the purpose of reporting as required by the West Virginia Department of Natural Resources, all commercial or institutional establishments must submit tonnage amounts and types of recyclables to the office of the City Manager on a form provided by the City of Martinsburg for such purposes, annually, or as often as deemed necessary by the City Council. Reports for the preceding year shall be due to the office of the City Manager on the dates shown on the forms supplied by the City.
