(a) "Aluminum" shall mean all products made of aluminum including aluminum cans, foil, wrappers, containers for prepared dinners and similar type aluminum.
(b) "Cans" shall mean containers comprised of aluminum, tin, steel or a combination thereof that have been approved for recycling by the Martinsburg City Council.
(1) Includes, but not limited to: Cans formerly containing such substances as vegetables, meats, fruits, juices, or other similar food storage containers constructed of materials listed above.
(2) Does not include: Aerosol cans, hazardous cleaning substances, automotive supply cans (eg. transmission fluids, motor oils, etc.), and other similar containers.
(c) "Cardboard" shall mean all clean corrugated cardboard constructed of two pieces of paper with a corrugated center normally used for packing, mailing, shipping or containerizing goods, merchandise or other material, but "excluding" plastic, foam, or wax coated or soiled cardboard such as cereal boxes, milk cartons, shoe boxes and other similarly constructed items.
(d) "Co-mingled" shall mean source separated, non-putrescible recyclable materials that have been mixed at the source of generation (i.e., placed in the same container).
(e) "Contractor" shall mean a person or company designated by the City Council to collect, transport, and market recyclables.
(f) "Designated Recyclable Materials" shall mean those recyclable materials to be source separated within the City. The term includes, but is not limited to, glass, cans, plastic bottles, newspaper, bi-metals, aluminum, white office paper, cardboard, mixed paper, white goods, scrap metal, used motor oil, anti-freeze, yard waste, and tires.
(h) "Disposition” or "disposition of designated recyclable materials" shall mean the transportation, placement, or arrangement of designated recyclable materials for all possible end uses "except" disposal as solid waste.
(i) "Glass" shall mean all products made from silica or sand, soda ash and limestone, the product being either transparent or translucent having been used for packaging or bottling of various matter. Glass shall not include crystal, ceramics, lightbulbs, and window plate, laminated, wired, pyrex or mirrored glass.
(j) "High-Grade office paper" shall include paper items generated by offices and/or commercial entities. This may include white computer paper, white copier paper, white typing paper, white letterhead paper, white note pad paper, and other similar office paper.
(k) "Leaf and Yard Waste Facility" shall mean a drop-off point or area designated by the City Council where leaves, grass clippings, tree trimmings, brush, and garden residue shall be delivered for processing.
(1) "Municipality" shall mean the City of Martinsburg located within the County of Berkeley, West Virginia.
(m) "Newspaper" shall mean any ground wood type paper used for newsprint.
(n) "Person" shall mean any individual, firm, partnership. corporation, association, cooperative enterprise, trust, municipal authority, federal institution or agency, state institution or agency, municipality, public and private schools and educational facilities, other governmental agency or any other entity or any group of such persons which is recognized by law. In any provisions of this article prescribing a fine, penalty, or imprisonment, the term "person" shall include the officers and directors of a corporation or other legal entity having officers and directors.
(o) "Pick-Up Point" shall mean a location designated by the City Council where recyclables are to be placed for receipt by the City and/or the Contractor.
(p) "Plastic" shall mean any material made from any of a group of synthetics containing polyethylene terephthalate such as plastic soda bottles, milk and water jugs which also includes high density polyethylene (HDPE) such as milk and water jugs and similar type juice jugs, bleach and detergent bottles etc.
(q) "Recyclable Material" shall mean a material that would otherwise become solid waste, that can be collected, separated or processed, and returned to the economic mainstream in the form of raw materials or products.
(r) "Recycling" shall mean any process whereby materials would otherwise become solid waste, are collected, separated or processed, and returned to the economic mainstream in the form of raw materials or products.
(s) "Recycling Coordinator" shall be the person appointed by the City Manager.
(t) "Recycling Container" shall mean the container furnished by the resident/businesses/government institution/waste hauler for the express purpose of storing recyclables for collection by the City Public Works Department or the recycling contractor.
(u) "Resident" shall mean any human being residing within the City on a temporary or permanent basis, but excluding persons residing in hotels, motels or similar type establishment.
(v) "Solid Waste" shall mean garbage, refuse, and other discarded materials resulting from commercial, industrial, institutional, residential, and community activities.
(w) "Source Separate" shall mean to separate recyclable materials from the solid waste stream at the point of waste generation i.e. household, business, institution, etc.
(x) "White Goods" shall mean any household or business appliances made of metal components such as refrigerators, washing machines, clothes dryers, etc.
(y) "Yard Waste" shall include leaves, tree trimmings, brush, grass clippings, and garden residue. (Ord. 93-17. Passed 8-3-93.)
